By setting up and maintaining your account, you must provide accurate and complete information at all times, including a valid email address. You assume full responsibility for the account and everything that happens on it, including damages o18 injuries (suffered by us or anyone else) caused by someone using your account without permission. This means you must be careful with your password. You cannot transfer your account to another person or use someone else's account. If you contact us to request access to an account, we won't grant it unless you can provide us with the necessary information to prove that you are the owner of said account.

If you share your login credentials with another person, you'll assume all responsibility for what happens with your account, and Teamperature will not mediate conflicts that may arise between individuals who have shared their login credentials. If you discover that someone else may be using your account without permission or suspect any other security breach is taking place, you must immediately contact Teamperature and inform us. We may ask for certain information to confirm that you are indeed the owner of the account.

You can cancel your account at any time, although in doing so, you may lose all information contained within it.

Teamperature is a software product aimed at assessing the drivers of cognitive load of a team at work, helping the User to decide on necessary actions for successfully addressing excessive team cognitive load.

In general terms, the service includes the following features:

The User can generate reports on the cognitive load status of a team in their private area.

To do this, the User will add team members to be evaluated and set up a survey to be answered by the team members.

Once all team members have answered, or, alternatively, when the survey ends and a minimum threshold of answers is achieved, the Report will be generated. The minimum threshold follows strict criteria that ensures individual team member’s answers cannot be tracked or traced.

Once the assessment is completed, the Service will provide the User with a Report for their own use. The Report can be shared with third parties without a Teamperature account at the sole discretion of the User. The User bears full responsibility for sharing the Report with their own team or other people inside or outside their organization. Teamperature shall not be responsible for any misuse or undue access to the Report once it’s been shared by the User.

In any case, Teamperature reserves the right to modify pricing as deemed appropriate at any time, so it is possible that the  services offered may be updated according to changing needs.

In such cases, Teamperature will notify Users of the price change 30 days in advance via email. If the User does not agree with the new price, they may opt to terminate their subscription.

The payment method for subscription plans is by credit card. Teamperature uses Stripe for processing of payments.

Companies with particular conditions might have other payment options available to them. In such cases, the particular conditions prevail over these terms and conditions.

In application of the Spanish General Law for the Defense of Consumers and Users, the User has a period of 14 calendar days from the time of contracting to notify that they wish to cancel the purchase or contract.

Any subscription is automatically renewed unless the User cancels the subscription at any time prior to the renewal date. To cancel your subscription, please log in to your personal account area and follow the cancellation procedures as outlined therein.

Except in the case of the right of withdrawal provided for in the preceding clause, no amount paid for the service will be refunded.

Once the renewal is canceled, you may continue to use the service until the remaining contracted period is exhausted.

Upon expiration of the subscription the User will be able to keep the history of generated reports and account data.

In case of account deletion, the User will lose all generated data. The User understands that in this case Teamperature is not liable for data loss once the account is deleted. To delete the account, please, send a request to help@teamperature.com from the email associated with your account.

Property of Teamperature: Teamperature is the exclusive owner of all intellectual, industrial, and similar property rights that may pertain to the Application and Website. Additionally, all rights to any Content, Services, or elements of its property that are incorporated into the Application and Website are reserved in favor of Teamperature, including, but not limited to:

• elements that make up the visual appearance, graphic image, and other sensory stimuli of the web pages that make up the Application and the Website;

• the navigation architecture;

• the source codes of all web pages;

• photographs;

• computer programs;

• databases;

• technology, assessment models, or developed tools;

•  logos; and

• distinctive signs.

Hereinafter, all of the above will be collectively referred to as the "Property."

The User acknowledges that under these General Conditions, Teamperature does not assign or transfer to the User any right over its Property, or over any third-party property that it may legally use. Teamperature only authorizes the User to access and use the Property in accordance with the terms indicated in these Conditions.

Teamperature authorizes Users to access and navigate the Application and Website, using the Services and viewing the Content incorporated therein.

Users are not authorized to copy, distribute (including emails and the Internet), transmit, communicate, modify, alter, transform, assign, or in any other way engage in activities that involve the commercial use of the Application or Website, their pages, Content, models, survey questions, assessments, or elements that comprise it, whether in whole or in part.

Teamperature authorizes the User to share reports and data obtained using the service, so the User may either share the generated link or download the content and reproduce, distribute, or communicate it. In any case, the usage license recognized in this section cannot, under any circumstances, be assigned or transferred to third parties, used to copy, develop a similar tool, or reverse-engineer it.

Access to, viewing, and, where applicable, downloading of the Content generated by the Services will always and in all cases be for strictly internal use, i.e, for the organization itself.

The User is permitted to use Teamperature’s Application, website, data and other service elements to provide consulting, advice, research or similar services to third parties, whether for free or commercially, as long as the following conditions are met:

1. All information generated using Teamperature’s services must be properly attribute to Teamperature.

2. Any deliverable elements (for e.g. reports) must be provided to the third party in their original form, preserving teamperature’s name, branding and overall presentation.

Teamperature reserves all rights to the Property including, but not limited to, all intellectual and industrial property rights it holds over them. Teamperature does not grant any other license or authorization of use to the User over its Property other than that expressly detailed in this clause.

The report will be provided for the User's exclusive information, use, and benefit; therefore, they will have the right to use the report for internal evaluations and to share the results both privately, for example with their team or across teams or departments.

The User is solely responsible for the data inserted in the assessment including the answers given by team members, as well as for taking the necessary actions and measures for the management of the teams’ cognitive load.

Teamperature guarantees that the services offered will comply with their description, with the following limitations:

• All implied warranties and conditions will be valid only during the validity of the services offered, to the extent permitted by the legislation.

• Problems caused by accident, abuse, or use of the services in a manner incompatible with what is offered, or arising from events beyond Teamperature's reasonable control are not covered.

• The guarantees do not apply to periods of downtime or other operational issues or interruptions in access.

• The truthfulness or accuracy of the reports is not guaranteed, as they depend on the responses of the team members.

Teamperature has taken all necessary technological measures, within its possibilities, to ensure the proper functioning of the application and commits to making periodic improvements to avoid any errors in the content that may appear on the Teamperature Application and Website. Teamperature does not guarantee or accept responsibility for:

If any clause of these Terms and Conditions, Privacy Policy, or Cookies is declared totally or partially void or ineffective, such nullity or ineffectiveness will only affect that provision, with the other conditions remaining in force, and the affected provision being considered as not included.

• The availability or continuity of the content on its website.

• The absence of errors in said content.

• Temporary interruptions of service, delays, errors, malfunctions, and, in general, other inconveniences that have their origin in causes beyond Teamperature's control, and/or are due to the intentional or negligent actions of the User and/or are caused by Force Majeure.

• The possibility of viruses or other elements that may cause alterations in the User's computer systems (software and hardware) or in their electronic documents and files contained therein.

• Use of the Teamperature application by the User in a way that may constitute a violation of any kind of national or international rule, intellectual or industrial property rights, or any other rights of third parties.

• Possible security errors that may occur or the possible damages that may be caused to the User's computer system (hardware and software), files, or documents stored therein, as a result of browser malfunction or the use of outdated versions thereof.

• The state of the links contained on the Teamperature Application and Website that may lead the User to other websites and web pages managed by third parties. Teamperature does not respond to the content or status of said websites and web pages. Accessing them through the Teamperature Application or Website does not imply that Teamperature recommends or approves their content.

• Teamperature is not responsible for the availability of third-party tools that may be employed on the Application or Website, such as PayPal or Stripe, nor for the damages they may cause. Teamperature will only be responsible for actions carried out by itself.

The User is strictly prohibited from:

• Violating or attempting to violate the security of Teamperature Application and Website (teamperature.com).

• Performing web scraping.

• Modifying, reverse-engineering, or communicating with Teamperature's backend services directly.

• Decompiling, disassembling, or otherwise manipulating any part of the offered services.

• Attempting or performing any action that violates Teamperature's intellectual property or know-how.

• Assigning their credentials or allowing third-party access to the Teamperature application without having a special license or prior written permission from Teamperature.

• Using the software in a way that prevents or may prevent its normal operation.

• Disclosing or publishing the software, or making it available to third parties in any form.

We are not responsible for the content of linked third-party websites and make no representation or warranty regarding their content or accuracy. Teamperature reserves the right to update and modify these legal texts at any time. Therefore, the User is advised to check and read them every time the Application and Website are accessed or used.We will notify you by email of any significant changes to the terms and conditions.

If any clause of these Terms and Conditions, Privacy Policy, or Cookies Policy is declared totally or partially void or ineffective, such nullity or ineffectiveness will only affect that provision, with the other conditions remaining in force, and the affected provision being considered as not included.

Whenever the User is not a consumer or User, and when there is no rule obliging otherwise, the parties agree to submit to the Courts and Tribunals of Madrid, as this is the place of the contract's celebration, with an express waiver of any other jurisdiction that may correspond to them.
